SBA’s prolific August rule-making
SBA has been busy with rule-making activity covering a number of its socioeconomic programs. These proposed rules have been well-covered elsewhere; we are linking to some of those sources.
8(a) program updates
SBA seeks to harmonize program requirements across veteran-owned, HUBZone, woman-owned, and 8(a) programs and therefore is updating 8(a) ownership requirements, among other things, for one set of rules for cross-socioeconomic-category businesses to follow. Koprince has a great write-up here.
HUBZone changes
HUBZones would be required to certify compliance with each offer instead of only once per year, because SBA is worried about abuses. Koprince again.
Mentor-protege joint venture changes
Finally, SBA issued a proposed rule to clarify how agencies should evaluate past performance and other corporate attributes for joint ventures, emphasizing that while agencies can require some past performance from protégé , they cannot demand the same evaluation criteria as for mentors or other offerors.
